- All promotions, sales and/offers are valid in South Africa only (unless otherwise communicated), while stocks last and subject to availability.
- Promotional and/or targeted SMS codes exclude value added offers and/or promotions.
- Online and in-store vouchers and/or gift vouchers cannot be used in conjunction with offers, promotions, sales (special offers are not repeated)
- We only accept mall/shopping centre vouchers, Carrol Boyes Store Gift Vouchers or Carrol Boyes online vouchers, these vouchers contain a valid serial number or unique code. Any voucher without a code/serial number are no longer redeemable.
- Tutuka Gift Cards are only redeemable in-store and not online. Tutuka Gift Cards will no longer be accepted from 1 August 2024. All Tutuka Gift Cards must be redeemed in one of our stores by 31 July 2024. Tutuka Gift Cards that cannot be redeemed by this date, will be subject to validation instore before use.
- We reserve the right to withdraw an item from sale at any time. All items are shown subject to availability and while stocks last.
- We reserve the right to place selected items or ranges on offer or promotion at any time and without prior notice.
- We will communicate with you to confirm once your order has been placed. Placing products in a wish list or shopping basket without completing the checkout process does not constitute as an order placed.
- We will not be held liable if products are removed from your shopping basket or wish list due to stock availability when completing the checkout process at a later stage.
- We shall take all reasonable efforts to monitor our stock levels related to products on offer. However, we cannot guarantee stock availability and pricing may vary at any time without prior notice.
- For Online Purchases, Carrol Boyes offers a gift wrapping service as an added benefit. Unfortunately, this service does not cater for high volume purchases where individuals are reselling in large quantities. For volumes of more than 5 units per customers, additional wrapping will be quoted accordingly.
- Exclusive online offers are not redeemable, refundable, or exchangeable in-store.

Terms & Conditions for Promotional Codes
- Applicable only to purchases made on Carrol Boyes website or official stores. One promotional code applies per customer per transaction.
- Promotional codes are non-refundable, non-transferable, and not redeemable for cash.
- If items purchased with a promotion code are returned, the refund will be processed based on the amount paid after the discount. Promotion codes will not be reissued. (e.g. if the purchase value inclusive of the code is R1000, only R750 will be refunded, the coupon value of R250 will not be refunded)
- Carrol Boyes is not liable for lost or stolen promotion codes.
- Carrol Boyes reserves the right to cancel or modify any promotion code at any time without prior notice.
- Any misuse of the promotion code, including but not limited to resale, duplication, or fraud, will result in cancellation of the order.
Gift Voucher Terms & Conditions
- Gift Vouchers expire 3 years from the date of purchase.
- If a Gift Voucher is lost or stolen, Carrol Boyes will not be liable for reimbursement or compensation of any nature.
- Gift Vouchers cannot be exchanged for cash.
- Gift Vouchers may be exchanged for products of a higher value, on payment of the difference.
- Gift Vouchers will be subject to verification at the time of presentation.
Pricing
- We will take all necessary efforts to accurately display product description, availability, price and delivery fees on our site and in-store. However, in case of mistakes of any nature, and which are not due to gross negligence, we will not be held responsible for any loss, claim or expense referring to a transaction based on these errors.
- Prices are shown in South African Rand (ZAR), United States Dollars (USD), Australian Dollars (AUD), New Zealand Dollars (NZD), Great British Pound (GBP) and Euro (EUR) and will display according to the currency selected from the top right corner of the homepage. South African Rands (ZAR) prices are only applicable when products are delivered within South Africa. Prices will recalculate at checkout based on delivery address information.

Carrol Boyes Competitions | Standard Terms & Conditions
- The promoter is Carrol Boyes (Pty) Ltd ("the Promoter") and is also referred to as the ‘company’.
- All participants that enter competitions via any Carrol Boyes platform indemnify the company against any, and all, claims of any nature whatsoever, arising out of and/or from their participation in any competition.
- The company reserves the right to substitute prizes with any other prize of comparable commercial value.
- Competition entries will be declared invalid if they are found to be either unclear, illegible or contain errors. The onus is on the participants to check the validity of their information submitted.
- The Promoter shall not be responsible for any lost, damaged, or delayed entries for any reason whatsoever. Proof of sending to enter a competition will not be accepted as proof of receipt.
- No Carrol Boyes employee (both permanent and non-permanent), representative, supplier or contractor is allowed to participate in any competition, unless otherwise advised.
- In certain instances, competitions will be available for single or across multiple entities and at different occasions/times based on specific competition rules which will be specified.
- Competitions are communicated via; e-mail, SMS, publications, dedicated websites, digital (social) media platforms, broadcast, and printed material.
- The company will use reasonable efforts to contact competition winners during working hours, either telephonically or via e-mail on the contact number or e-mail address as provided in their competition entry.
- The Carrol Boyes Marketing Team will endeavour to contact the potential prize winner/s within two weeks from the draw date.
- The potential prize winner may be required to provide or verify their personal details they entered by a Carrol Boyes representative. The potential prize winner is not an actual winner until his / her submission is validated and satisfies the qualifying criteria set by the promoter. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited.
- Prizes will also be forfeited if the company is unable to contact the eligible prize winner. The draw will then be done again, and due process followed.
- The Promoter reserves the right to disqualify any claim if fraud or cheating is suspected, including without limitation, through the manipulation of code or otherwise falsifying data.
- Any attempt to use multiple e-mail accounts or other tactics to enter more than the stated limit may result in disqualification and all associated entries will be void.
- Entries generated by script, macro, bot, commercial contest subscription, incentives or other means that do not conform to the terms or spirit of the set-out competition rules, will void the entry, and may disqualify the entrant.
- The company may require winners to complete an information disclosure document and/or indemnification to ensure compliance with these rules and the Consumer Protection Act 68 of 2008. Should any winner refuse or be unable to comply, such a winner will be deemed to have rejected the prize.
- The company may require winner/s be identified and/or photographed and the photographs published in printed or electronic media. The winner/s have the right to decline the publication of their images or details, and to participate in marketing material in so far as it relates to the competition.
- The Promoter shall have the right to change or terminate any competition and without notice, for any reason which the Promoter reasonably deems necessary. In the event of such change or termination, all participants agree to waive any rights that they have in respect of the competition and acknowledge that they will have no recourse against the Promoter or its agents.
- Neither the Promoter, its agents, its associated companies, nor any directors, officers or employees of such, shall be liable for any loss or damage, whether direct, indirect, consequential or otherwise arising from any cause whatsoever, which may be suffered by the participant/s or winner/s.
- Participation in competitions constitutes acceptance of the promotional rules and participants agree to abide by the rules, which will be interpreted by the company’s appointed judges, whose decision regarding any dispute will be final and binding.
- In the event that the prize is not available, despite the Promoter's reasonable endeavours to procure the prize, the Promoter reserves the right to substitute prizes of equal value.
- Prize(s) are neither transferable nor redeemable for cash. Prizes are subject to availability and the company may substitute prizes for alternative products or services of similar value.
- If winning entries to a Competition are open to subjective interpretation, an independent judge or a panel that includes one independent member will be appointed. Such judges or panel members will be competent to judge the competition and their full names will be made available on request.
- In all matters, the decision of the appointed judge or panel shall be final, and no correspondence or discussion shall be entered into.
- The Promoter assumes no liability whatsoever for any entry that has been omitted from participation for any reason whatsoever. The Promoter is not liable for any technical failures affecting the participation and/or voucher redemption process of the competition.
- All entries that are allowed and received via the official Carrol Boyes Facebook and Instagram or other social media pages are subject to above rules.
- Competition draws are run in accordance with the Consumer Protection Act.
- All information provided by entrants are subject to the Protection of Personal Information Act 4 of 2013, and the company will ensure compliance in this regard.
- To the best of the Promoter’s knowledge, all competition information is correct, but will not be held responsible if an error or omission has been committed.
Carrol Boyes Collection Wines – Terms and Conditions
- Age Restriction and Verification
- In accordance with the Liquor Act 59 of 2003, Carrol Boyes Collection Wines are only available for purchase by individuals 18 years or older. By placing an order, you confirm that you are of legal drinking age in South Africa.
Age verification is required at two stages:
- At the time of placing an order, you will be required to enter your date of birth and ID number.
- At the time of delivery, the recipient must present a valid form of identification (South African ID, passport, or driver's license) to verify their age.
- If you are unable to provide valid proof of age upon delivery, or if our delivery personnel reasonably believe that the Products may be acquired for a person under 18 years of age, we reserve the right to refuse delivery. In such cases, you will be charged for the cost of the Products and the delivery fee.
- Product Availability and Pricing
- All products are subject to availability. Prices are listed in South African Rand (ZAR) and include VAT unless otherwise stated. Carrol Boyes reserves the right to change prices and availability without notice.
- Placing an Order
- When placing an order, whether via website or email, please ensure that all information provided is accurate and complete.
- Once an order is placed, you will receive a confirmation email with order details. This email does not constitute acceptance of your order.
- Acceptance of your order occurs upon dispatch of the products.
- Orders may be placed at any time; however, orders will only be processed during legal liquor trading hours as determined by the relevant municipal and provincial regulations based on the delivery address.
- We reserve the right to limit the quantities of any Products that we offer.
- Payment
- Payment must be made in full before orders are processed and dispatched.
- Online orders will be processed through our secure payment gateway.
- For email orders, payment instructions will be provided upon confirmation.
- We accept payment via credit card, debit card, instant EFT, and other payment methods as indicated on our website.
- Your payment information is processed securely through our payment service providers in accordance with industry standards.
- Delivery
- Delivery is only available within the borders of South Africa.
- Delivery timelines and costs will be communicated at the time of purchase.
- Deliveries will only be made during legal liquor trading hours as determined by the relevant municipal and provincial regulations based on the delivery address.
- Please ensure someone of legal drinking age is available to receive the delivery and provide identification if requested.
- Delivery can only be made to the person who placed the order, and valid identification must be presented upon delivery.
- If no one is available to accept delivery, our courier will leave a notice and attempt delivery on the next business day. After three failed delivery attempts, the Products will be returned to our facility, and you will be charged for the cost of the Products and the delivery fee.
- Risk of loss or damage to the Products passes to you upon delivery.
- Returns and Refunds
- Returns and refunds are handled in accordance with the Consumer Protection Act 68 of 2008.
- If you receive damaged or incorrect products, please notify us within 7 days of delivery at cbwines@cbfa.co.za to arrange for an exchange or refund.
- Due to the nature of our products, we cannot accept returns on opened or consumed items.
- If your return request is approved, we will arrange for the collection of the Products and issue a refund or replacement at our discretion.
- Refunds will be processed using the same payment method used for the original purchase and will typically be completed within 7-14 business days.
- Responsible Consumption
- Carrol Boyes promotes responsible consumption of alcoholic beverages and does not support excessive or irresponsible drinking.
- We reserve the right to refuse service to anyone who appears to be intoxicated or who has a history of alcohol abuse.

- Compliance with Laws
- All sales are subject to applicable South African laws, including the Liquor Act, Act 4 of 2008, and other relevant provincial and municipal regulations.
- Carrol Boyes holds all necessary licenses and permits required for the online sale and delivery of alcoholic beverages in South Africa.
- Any attempt to circumvent age verification measures or other legal requirements is strictly prohibited and may result in the cancellation of orders and/or legal action.
- Privacy Policy
- All personal information collected during the ordering process will be handled in accordance with the Protection of Personal Information Act (POPIA).
- By placing an order, you consent to the collection and processing of your personal information, including your age verification details, for the purposes of processing and fulfilling your order.

- Limitation of Liability
- Carrol Boyes will not be held liable for any direct or indirect loss or damage resulting from the use of our website, the purchase or consumption of our products, or delays in delivery beyond our reasonable control.
- Our total liability to you for any claim arising out of or relating to these Terms or your purchase of Products shall not exceed the amount paid by you for the Products that are the subject of the claim.
- Force Majeure
- Carrol Boyes shall not be liable for any delay or failure to perform its obligations under these Terms if such delay or failure results from events or circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemic, epidemic, government restrictions, war, terrorism, labour disputes, or civil unrest.
- Governing Law
- These Terms are governed by the laws of the Republic of South Africa.
- Any disputes arising shall be subject to the exclusive jurisdiction of the South African courts.
- Severabilty
- If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
