Carrol Boyes Competitions | Standard Terms & Conditions
- The promoter is Carrol Boyes (Pty) Ltd ("the Promoter") and is also referred to as the company.
- All participants that enter competitions via any Carrol Boyes platform indemnify the company against any and all claims of any nature whatsoever arising out of and/or from their participation in any competition.
- No Carrol Boyes employee (both permanent and non-permanent), representative, supplier or contractor is allowed to participate in any competition, unless otherwise advised.
- In certain instances, competitions will be available for single or across multiple entities and at different occasions/times based on specific competition rules which will be specified.
- Competition entries will be declared invalid if they are found to be either unclear, illegible or contain errors. The onus is on the participants to check the validity of their information submitted.
- The Promoter shall not be responsible for any lost, damaged, or delayed entries for any reason whatsoever. Proof of sending to enter a competition will not be accepted as proof of receipt.
- Any attempt to use multiple e-mail accounts or other tactics to enter more than the stated limit may result in disqualification and all associated entries will be void.
- Entries generated by script, macro, bot, commercial contest subscription, incentives or other means that do not conform to the terms or spirit of the set-out competition rules will void the entry and may disqualify the entrant.
- The Promoter reserves the right to disqualify any claim if fraud or cheating is suspected, including without limitation, through the manipulation of code or otherwise falsifying data.
- All entries that are allowed and received via the official Carrol Boyes Facebook and Instagram or other social media pages are subject to the above rules.
- The Promoter assumes no liability whatsoever for any entry that has been omitted from participation for any reason whatsoever. The Promoter is not liable for any technical failures affecting the participation and/or voucher redemption process of the competition.
- Competitions are communicated via e-mail, SMS, publications, dedicated websites, digital (social) media platforms, broadcast and printed material.
- The company will use reasonable efforts to contact competition winners during working hours, either telephonically or via e-mail on the contact number or e-mail address as provided in their competition entry.
- The Carrol Boyes Marketing Team will endeavour to contact the potential prize winner/s within two weeks from the draw date.
- The potential prize winner may be required to provide or verify their personal details entered by a Carrol Boyes representative. The potential prize winner is not an actual winner until their submission is validated and satisfies the qualifying criteria set by the promoter. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited.
- Prizes will also be forfeited if the company is unable to contact the eligible prize winner. The draw will then be done again, and due process followed.
- The company reserves the right to substitute prizes with any other prize of comparable commercial value.
- Prize(s) are neither transferable nor redeemable for cash. Prizes are subject to availability and the company may substitute prizes for alternative products or services of similar value.
- In the event that the prize is not available, despite the Promoter's reasonable endeavours to procure the prize, the Promoter reserves the right to substitute prizes of equal value.
- The company may require winners to complete an information disclosure document and/or indemnification to ensure compliance with these rules and the Consumer Protection Act 68 of 2008. Should any winner refuse or be unable to comply, such a winner will be deemed to have rejected the prize.
- If winning entries to a competition are open to subjective interpretation, an independent judge or a panel that includes one independent member will be appointed. Such judges or panel members will be competent to judge the competition and their full names will be made available on request.
- In all matters, the decision of the appointed judge or panel shall be final, and no correspondence or discussion shall be entered into.
- Participation in competitions constitutes acceptance of the promotional rules and participants agree to abide by the rules, which will be interpreted by the company's appointed judges, whose decision regarding any dispute will be final and binding.
- Competition draws are run in accordance with the Consumer Protection Act.
- The company may require winner/s to be identified and/or photographed and the photographs published in printed or electronic media. The winner/s have the right to decline publication of their images or details, and to participate in marketing material insofar as it relates to the competition.
- All information provided by entrants are subject to the Protection of Personal Information Act 4 of 2013, and the company will ensure compliance in this regard.
- Neither the Promoter, its agents, associated companies, nor any directors, officers or employees of such shall be liable for any loss or damage, whether direct, indirect, consequential or otherwise arising from any cause whatsoever, which may be suffered by the participant/s or winner/s.
- The Promoter shall have the right to change or terminate any competition without notice, for any reason which the Promoter reasonably deems necessary. In the event of such change or termination, all participants agree to waive any rights that they have in respect of the competition and acknowledge that they will have no recourse against the Promoter or its agents.
- To the best of the Promoter's knowledge, all competition information is correct, but will not be held responsible if an error or omission has been committed.
